What is Liberty Protection Safeguards training?
Liberty Protection Safeguards (LPS) training explains the legal framework introduced by the Mental Capacity (Amendment) Act 2019 for authorising arrangements that amount to a deprivation of liberty for people aged 16 or over who lack capacity to consent to those arrangements.
LPS is intended to replace the Deprivation of Liberty Safeguards (DoLS) in England and Wales. However, LPS has not yet replaced DoLS in practice, and the existing DoLS framework continues to operate while implementation work continues.
The course introduces learners to responsible bodies, appropriate persons, Independent Mental Capacity Advocates (IMCAs), assessments, consultation, pre-authorisation reviews, authorisation and ongoing reviews. It also helps learners understand how mental capacity, individual rights, wishes and feelings should influence decisions about restrictive care arrangements.

Is Liberty Protection Safeguards training a legal requirement in the UK?
There is no general UK law stating that every health or social care worker must complete a specifically titled “Liberty Protection Safeguards training course”.
However, organisations and professionals must meet their legal responsibilities under applicable mental capacity, human rights and deprivation of liberty law. In England and Wales, the Mental Capacity Act 2005 provides the core framework for decisions involving people who may lack capacity. Professionals acting in relation to people who lack capacity must also have regard to the Mental Capacity Act Code of Practice where the Act requires this.
The Mental Capacity (Amendment) Act 2019 created the LPS framework, but implementation has not yet replaced the current DoLS system. Employers should therefore ensure relevant staff understand current DoLS requirements as well as developments relating to LPS, rather than treating LPS as already fully operational.
