Is Multiple sclerosis training a legal requirement in the UK?

There is no general UK law requiring every employee or health and social care worker to complete a specific Multiple Sclerosis training course. Employers should instead determine training requirements according to staff roles, responsibilities and the needs of the people they support.

There is, however, important equality legislation relating to MS. In England, Wales and Scotland, Schedule 1 of the Equality Act 2010 specifically provides that multiple sclerosis is a disability. A person with MS is therefore protected under the Act from diagnosis, and employers may have duties concerning discrimination and reasonable adjustments.

The Equality Act 2010 does not apply to Northern Ireland, where separate disability discrimination legislation applies.

Employers should determine whether the course is appropriate by considering the worker’s responsibilities and the needs of the people receiving care or support.

There is no general legal requirement for UK workers to hold a specific Multiple Sclerosis training certificate. However, employers must ensure workers have appropriate competence for their responsibilities. In England, Wales and Scotland, MS is specifically treated as a disability under Schedule 1 of the Equality Act 2010 from the point of diagnosis.

NICE states that diagnosis should be made using history, examination, MRI and laboratory findings, following the revised McDonald criteria. Treatment may include disease-modifying therapies, treatment for relapses and personalised management of individual symptoms.

There is no universal statutory refresher interval for Multiple Sclerosis awareness training. Employers should decide when refresher training is appropriate based on job roles, competence, organisational policy, changes in guidance and the needs of people receiving support. Refresher training may also be appropriate when staff responsibilities change or additional knowledge of MS is required.
