Patients Lacking Capacity

If a patient lacks capacity to make a decision regarding a chaperone, the staff must treat the patient in accordance with the Mental Capacity Act 2005. This means that the person lacking capacity is not treated in a discriminatory manner, and that any act done for, or decision made on behalf of the patient is done or made in their best interests.
